Subject: HLU-20 — Support for Noelani’s Inclusion in Resolution 26-129
You don't often get email from courtneyweiche@gmail.com. Learn why this is important
Aloha Chair Uʻu-Hodgins and Members of the Housing and Land Use Committee,
I am writing in support of Council Chair Alice Lee’s proposed Amendment No. 1 to Resolution 26-129, and specifically to request that Noelani Condominiums remain included in the proposed Community Plan amendment and change in zoning to H-4.
I offer this perspective not only as someone whose family has owned at Noelani for decades, but also as a land-use planner with nearly two decades of professional experience, including work in the Lake Tahoe Basin and Eastern Sierra communities including Mammoth Lakes, CA. These tourism-dependent communities confront acute workforce and affordable-housing shortages and are frequently raised as comparisons in discussions about Maui’s short-term-rental policies. I offer the following observations solely in my personal capacity and not on behalf of any current or former employer.
My professional experience has shown me that reasonable regulation of short-term rentals is necessary, particularly where transient accommodations have displaced conventional housing in established residential neighborhoods. However, land-use regulations are most effective and defensible when they distinguish conventional residential housing from properties that were purpose-built, physically configured, and historically operated as visitor accommodations.
South Lake Tahoe’s broad Measure T restrictions ultimately resulted in years of litigation and are no longer enforceable, while the City has returned to a regulated permitting system. Mammoth Lakes takes a more property- and zoning-specific approach: transient rentals are prohibited in designated residential zones but remain permitted in Commercial, Residential Multi-Family 2, Resort, and Specific Plan zones. These experiences illustrate why a careful property-specific analysis is preferable to treating every property with an apartment zoning designation as interchangeable housing stock.
The apartment-district phaseout established by Ordinance 5909 will not, by itself, transform high-cost oceanfront resort condominiums into attainable workforce housing. Acquisition costs, substantial association assessments, insurance and coastal-maintenance obligations, limited parking, shared facilities, utility arrangements, and the physical configuration of individual properties all affect whether conversion to long-term residential use is financially and functionally realistic. Those considerations are particularly relevant at Noelani.
My family has owned our unit at Noelani since the early 1980s. Noelani’s lawful visitor-accommodation use was already well established when my grandparents purchased the property, and it has continued as an integral part of the condominium’s identity and operation for decades.
Noelani satisfies the eligibility framework established by Ordinance 6008. It is an A-2 Apartment-zoned property constructed in 1974 and is identified on Maui County’s June 27, 2024 list of apartment-district properties permitted to operate short-term occupancies.
Noelani also clearly satisfies the specific geographic criterion being considered under Resolution 26-129. Council Chair Lee’s proposed Amendment No. 1 identifies Noelani by name, address, acreage, and tax map key. More importantly, the County’s own Sea Level Rise exhibit identifies the entire Noelani parcel as being within the 3.2-foot Sea Level Rise Exposure Area. Noelani is therefore not a marginal or speculative qualification under the criterion before the Committee.
I respectfully ask the Committee to apply that criterion consistently, adopt Council Chair Lee’s proposed Amendment No. 1, and retain Noelani in both the Community Plan amendment bill and the proposed change from A-2 Apartment to H-4 Hotel zoning.
This request would not expand the number of vacation-rental units, predetermine the ultimate zoning decision, or exempt Noelani from shoreline, Special Management Area, coastal-hazard, environmental, or other applicable requirements. It would allow an established and historically lawful visitor property to proceed through the full Planning Commission and Council review process contemplated by Ordinance 6008.
Mahalo for your consideration and for allowing Noelani’s owners to participate in this important process.

Dear Council Members
Thank you for your time and interest in reading this email. I am an owner at the Kamaole One
Condos, a very small condo building with extremely high costs and well within the SLRXA 3.2 foot sea level rise water excursion zone.
I hope that we can be allowed to continue as a short term rental due to both of these reasons.
I will also include that we have parking for one small vehicle per unit only and this can be difficult to maneuver in.
I appreciate your consideration in this matter of great importance.

Dear Maui Councilmembers:
As owners of a unit in Kahana Reef for more than 12 years, we’re writing to SUPPORT RESOLUTION 26-129.
• Per the definitions in Ordinance 6008, Kahana Reef most definitely would be eligible.
• Kahana Reef has vacation rented since it was first built and occupied in 1974. This means that we have had MORE THAN FIVE DECADES of providing accommodations to Maui tourists for them to enjoy our island, pay occupancy taxes and spend money on food and entertainment as well as airfare and rental cars.
• Additionally, per Chair Lee and Councilman Cook’s proposed amendments, you can see that Kahana Reef is clearly part of the sea level exposure, which is yet another criteria that you are looking at in allowing re-zoning and the continuation of short-term rentals.
We thank you for your arduous work on this wide-ranging and important legislation and for your support in assuring that Kahana Reef is included in this resolution and moving forward through the rezoning process.

WRITTEN TESTIMONY OF ROSANNA & JEFFERY LUCERO
Aloha Chair Kama, Vice-Chair Cook, and members of the Housing and Land Use Committee,
We are owners of Units #310 and #314 at Hale Kai O‘Kihei, located at 1310 Uluniu Road in Kīhei, and respectfully request that the Committee amend Resolution 26 129 to include Hale Kai O‘Kihei in Exhibits 1 and 2 for consideration of H 3 zoning under Ordinance 6008.
The amendment establishes a clear, objective standard: properties within the County recognized 3.2 foot Sea Level Rise Exposure Area (SLR XA) are eligible for inclusion. Hale Kai O‘Kihei meets that standard. The State’s 3.2 foot SLR XA mapping reaches our property and portions of our building footprint, and our location is also within FEMA Flood Zone AH. Our non elevated, slab on grade buildings were constructed in 1969.
Despite satisfying the stated criteria, Hale Kai O‘Kihei has been excluded while neighboring oceanfront A 1 Apartment zoned properties—facing the same erosion, access, SLR XA, and FEMA Zone AH risks—have been granted pathways to continue short term rental operations:
• Aloha Villas (1338 Uluniu Road) – Directly adjacent to us, built in 1980, included in Resolution 26 110 and the Ordinance 6008 rezoning process.
• Waiohuli Beach Duplex (64 W. Līpoa Street) – Also included in Resolution 26 110 despite identical coastal hazard exposure.
• Beach Paradise (1290 Uluniu Road) – Built in 2001 and allowed to continue STR operations through a 2020 individual permit, despite having a far shorter and less clearly documented STR history than Hale Kai O‘Kihei.
Hale Kai O‘Kihei is effectively sandwiched between properties that have been granted continued STR rights, while our decades long lawful vacation rental use is being terminated without any stated property specific distinction. This raises concerns about unequal and arbitrary application of land use policy.
We are requesting only the same opportunity for community plan amendment, Planning Commission review, and H 3 rezoning that neighboring properties received. Inclusion does not predetermine the outcome—it simply ensures fair and consistent treatment.
Sea Level Rise Mitigation Follow Up Hale Kai O‘Kihei has long engaged in responsible coastal management practices, including natural dune and vegetation restoration in cooperation with the State beginning around 2010. Uluniu Road’s documented drainage and flooding limitations—outlined in the County’s 2022 Kīhei Drainage Master Plan—further highlight the importance of evaluating access reliability when considering long term residential occupancy.
We are also obtaining proposals from Sea Engineering, Coastal Frontiers Corporation, and Coastal Planners, LLC for a professional Sea Level Rise Vulnerability, Adaptation and Mitigation Feasibility Assessment. This will provide an objective evaluation of what can be reasonably mitigated, what cannot, and why.
We respectfully ask the Committee to amend Exhibits 1 and 2 of Resolution 26 129 to include Hale Kai O‘Kihei. If the Committee believes our property does not meet the stated standard, we request that the objective, property specific reason for treating Hale Kai O‘Kihei differently from neighboring oceanfront properties be placed on the public record.
Mahalo for your time and consideration.
Respectfully submitted,
Rosanna & Jeffery Lucero

Aloha Chair Uʻu-Hodgins and members of the Housing and Land Use Committee,
I am writing in support of Chair Alice Lee’s Amendment #1 to Resolution 26-129, and specifically to request that Noelani, TMK (2) 4-3-009:002, remain included in the proposed Community Plan amendment and change in zoning to H-4.
My family has owned our unit at Noelani since the early 1980s. Noelani’s lawful visitor-accommodation use was already well established when my parents purchased the property, and it has continued as part of the condominium’s identity and operation for decades.

It also satisfies the specific criterion being considered under Resolution 26-129. Chair Lee’s Amendment #1 identifies Noelani by name, address, acreage, and tax map key and expressly states that the nine properties added by the amendment are within the Sea Level Rise Exposure Area.
I respectfully ask the Committee to apply that criterion consistently, adopt Chair Lee’s Amendment #1, and retain Noelani in both the Community Plan Amendment bill and the proposed change from A-2 Apartment to H-4 Hotel zoning.

To Whom it May Concern;
I am writing in support of Resolution 26-129. I ask the County Council Housing and Land Use Committee to approve the resolution and the proposed amendment, which adds Makani Sands to the list of condominiums to be exempted from Ordinance 5909.
The County Council’ HLU Committee has scheduled a hearing for Wednesday at 9:00 AM (HST) to consider Resolution 26-129, which proposes to exempt several condominiums from the phase-out of short term rentals by designating these properties and Class H-3 and H-4 Hotels. An amendment to this Resolution will also be considered on Wednesday; it proposes an H-4 exemption for Makani Sands. This is huge. Our attorney met with two Council Members several times and persuaded them to include us in the Resolution.
The folks at Lahaina Strong will send emails to the HLU Committee opposing Resolution 26-129, because they do not want any properties to be exempted from the short-term phase-out of Ordinance 5909 (formerly known as Bill 9). They want every condominium to become long-tern rentals for local families.

I am writing in support of Resolution 26-129. I ask the County Council Housing and Land Use Committee to approve the resolution and the proposed amendment, which adds Makani Sands to the list of condominiums to be exempted from Ordinance 5909.
Makani Sands is unique in that it can meet all four criteria for exemptions to Ordinance 5909:
1. Historically operated as a hotel. Our attorney has indisputable documentation on file.
2. Located in the sea level rise exclusion area (SLRXA) per the County's map viewer tool.
3. Also located in the Flood Zone per the County's map viewer tool.
4. Not affordable for local residents to purchase. Monthly payments exceed the County’s criterion of $4,500 per month (mortgage PMI, property tax, AOAO dues and Insurance).
Although Makani Sands clearly meets the required criteria, I would like to add some personal comments. We purchased our condominium in 2006 and have operated it as a short term rental (STR) every year since then with breaks only for Covid and the Lahaina fire. In every one of those years, income from rentals was less than expenses after covering mortgages, HOA dues, 3 special assessments and a very high real estate tax. Despite that, in those 20 years we have generated just over $200,000 in transient and general excise taxes for the County in addition to the premium real estate tax. I would be happy to provide precise numbers if you wish.
So why do we do this? We love Maui and this is the only way we can afford extended stays on the island, usually 2+ months a year. Maintaining STR capabilities is a win-win for us and Maui, and Resolution 26-129 would assure this.

Dear Council and Committee Members.
I am writing in support of Resolution 26-129. I ask the County Council Housing and Land Use Committee to approve the resolution and the proposed amendment, which addes Makani Sands to the list of the condominiums to be exempted from Ordinance 5909.
Aloha Chair and Members of the Housing and Land Use Committee.
We are owners at Hale Kai O'Kihei at 1310 Uluniu Road, Kihei. We are requesting that Hale Kai O'Kihei be included in the Council-initiated rezoning process under the same 3.2-foot Sea Level Rise Exposure Area (SLR-XA) and Flood Hazard criteria being applied to our immediate neighbors.
Hale Kai O'Kihei is a 59-unit, A-1 Apartment-zoned condominium built in 1969, with decades of lawful short-term rental use. We are located within the 3.2-foot SLR-XA with seawater inundation and within a FEMA Flood Hazard Zone, facing coastal erosion, passive flooding, annual high-wave flooding, drainage limitations, and risks to safe ingress/egress.
The unequal treatment on our same beach is now even more apparent:
To our SOUTH - both included:
Our next-door neighbor to the south, Aloha Villas (A-1), and just south of that, Waiohuli Beach Duplex at 64 West Lipoa Street (2 units, A-1). Both are A-1 Apartment-zoned oceanfront properties on the same shoreline, facing the same coastal hazards, and BOTH have been included in the Council-initiated rezoning process under Ordinance 6008 / Resolution 26-110.
To our NORTH - included despite no Minatoya rights:
Directly to our north is Beach Paradise. It is also A-1 zoned, but was built in 2002 - AFTER the Minatoya List - so it has no grandfathered short-term rental rights. It has only been permitted for STR for six years, yet it has been given a preserved pathway for STR.
Hale Kai O'Kihei - EXCLUDED:
We are 59 units, A-1 zoned, built in 1969 - over three decades before Beach Paradise. We are on the County's Minatoya short-term-occupancy list with a decades-longer history of lawful vacation-rental use than Beach Paradise. We meet the same 3.2-foot SLR-XA and FEMA flood criteria as our neighbors to the north and south. Yet we have been excluded from both pathways - the original Ordinance 6008 group and the SLR-XA criteria under Resolution 26-129. How does a 2002 property with no Minatoya rights and only six years of permitted STR use receive a preserved pathway, while a 1969, 59-unit, A-1 property on the same beach, with decades of lawful STR history and the same documented SLR-XA and flood exposure, is omitted?
There is no objective, property-specific basis for this distinction. We are asking only for the same process afforded to Aloha Villas, Waiohuli Beach Duplex, and Beach Paradise: inclusion in the community plan amendment, Planning Commission review, and H-3 rezoning process. Inclusion does not predetermine the final zoning decision - it simply gives Hale Kai O'Kihei the same opportunity for public and agency review.
We believe our omission is an oversight that should be corrected now.
Mahalo for your fair and objective application of the County's stated standards.
Kamaole One is an existing condominium property located at 2230 S. Kihei Road, Kihei, identified for
real property tax purposes as Tax Map Key (2) 3-9-005:023-0000 consisting of approximately 0.5 acres
(21780 Square Feet).
BASIS FOR INCLUSION
Kamaole One is a 12 unit complex with parking structure almost entirely located in the SLRXA 3.2 foot
sea level rise water excursion zone.
100% of our Association board of directors approved an amendment to the Association’s Bylaws
expressly authorizing the rezoning of Kamaole One under Hotel District zoning. Acting under that
authority, the Board supports inclusion of Kamaole One in the proposed Community Plan Amendment
and Change in Zoning so that the Planning Commission may evaluate the property together with the other
properties identified in Resolution 26-129.
The proposed amendment does not alter the scope or purpose of Resolution No. 26-129. It simply adds
Kamaole One to the list of properties that will be evaluated through the same Planning Commission
review process contemplated for the other properties identified in the Resolution. The scope of
resolution 26-129 is to include properties ebected by the 3.2 foot water excursion.
Kamaole One condo property assessments for the current year range from $ $1,377,900 to
$1,859,900 with an average unit assessed value of $1,569,466. There were 3 sales in the last 2 years with
an average sale price of $1,515,110.00. All of these sales were after the passage of Bill 9 and subsequent
reduction of over 30% in property assessments. The annual association dues are $15,945.92 ($1,328.91
per month) and average property taxes paid in 2025 were $19,271.65 per year. Kamaole One includes one

Resolutions 26-129 and 26-130
Aloha e Chair Uʻu-Hodgins, Vice Chair Batangan, and Members of the Housing and Land Use Committee:
I am a working parent raising two boys in Wailuku. I personally know four people who've had to move this year because they could not afford the place where they were currently living anymore.
These were both single people and people with families, all in situations where the price was going up and they could not afford the next jump.
At this time, any housing under consideration for vacation rentals needs to open up Maui residents who are in need of housing so that they have more options and at a more affordable price.
Please do not pass Resolutions 26-129 and 26-130, which would rezone about 500 units from residential to newly created H-3 and H-4 hotel zones. Please oppose all such proposals in the future.
Mahalo nui loa for your consideration of these housing concerns which are impacting so many in our community,

Sincerely,
Courtney Weiche, Noelani Condominium Owner

Mahalo,
Bob & Mary Alessandrelli

To Whom it May Concern;
Thank you,
Brad Taylor, Owner

Sincerely,
David and Dawn Mason

Dear Sir/Madam,
Decision Makers for Resolution 26-129
Kamaole One includes one
small, covered car port for each unit with no street or nearby parking available. Large vehicles or trucks
won’t fit in these stalls.Kamaole One 2230 S Kihei Road, Kihei, Hawaii 96753

OPPOSING
Mahalo nui loa for your consideration of these housing concerns which are impacting so many in our community,
Jenny Wall
