DRIP-25 / Bill 108 (2026) — Verification of Land Ownership Before Future Development Designations

Chair and Members of the DRIP Committee:

As the Committee continues its review of the South Maui Growth Framework, I would like to raise a fundamental question concerning the legal ownership of lands being considered for future development.

What evidence has Maui County required to establish that the individuals, corporations, trusts, government entities, or other parties identified as owners actually possess valid and legally enforceable ownership interests in the properties being considered?

The existence of a Tax Map Key, a real property tax account, a recorded deed, or a name appearing in County records should not be confused with a complete, independently verified chain of title.

South Maui's land history includes Land Commission Awards, Royal Patents, inheritance, conveyances, subdivisions, and other transactions extending back to the Hawaiian Kingdom.

If the County intends to establish new development potential through Bill 108, I believe it is reasonable to ask whether the legal foundation of ownership has been sufficiently established.

I therefore ask the Committee to consider the following:

    1. Proof of ownership: Should any party seeking a significant new land-use designation be required to provide documentation establishing its ownership or legal authority to act for the owner?

    2. Chain of title: Should the County require a current title report identifying the recorded chain of ownership, encumbrances, and any known unresolved claims before considering additional development entitlements?

    3. Historical interests: Should the Planning Department identify relevant Land Commission Awards, Royal Patents, kuleana interests, and other historical grants associated with affected parcels?

    4. Land Court registration: Should the Council request that the State Legislature evaluate whether additional judicial title verification or Land Court registration should be required for properties involving substantial new development potential or documented competing ownership claims?

    5. Public lands: Has the County independently verified the legal ownership and acquisition records for County-controlled properties included in the Growth Framework?

    6. Disputed ownership: Where material ownership disputes exist, should the County defer discretionary land-use changes until the appropriate legal authority has resolved them?

    7. Public accountability: What responsibility does the County assume when it relies on ownership representations that subsequently prove inaccurate?

I recognize that the County Council does not adjudicate private property ownership and that existing Hawaiʻi law recognizes both the Regular System and Land Court.

However, that distinction raises an important policy question:
Should the evidentiary standard for granting additional development potential be greater than merely accepting the ownership information already appearing in County records?

I am asking what independent verification the County has performed and what protections exist when competing ownership claims are presented.

Before the Council adopts a twenty-year plan identifying lands for additional development, it should understand the legal ownership information on which those decisions depend.

PLEASE address these questions in the public record before final recommendations on the Growth Framework are forwarded to the full County Council.

Aloha Esteemed Chair and Committee Members,

Please accept the attached testimony and supporting materials for consideration in the FY2028 budget process, relating to planning for South Maui and the safety of all Maui residents, visitors, and marine ecosystems. I respectfully propose:

    • $4 million for CBS-5031 to complete the Kīhei wastewater UV upgrades supporting 100% R-1 production.
    • $1.8 million for CBS-1169 to fully fund design for future UV disinfection and R-1 production at Wailuku-Kahului.

These investments would catapult Maui to the forefront of a movement that started with Bill 52 (Ord. 5592, 2024) to virtually eliminate the release of pathogens in municipal effluent across the community.

I also submit a September 8, 2026 court filing and a rough transcript with a link to the actual recording of a March 24, 2025 conversation disclosing the Maui Ocean Center permit violation to the relevant permit signatory and Robin Knox as supporting context for my concerns regarding Maʻalaea wastewater permitting, environmental protection, and public health. I was fired with a threatening text on April 3, 2025, one day after the signatory self-reported the violation to DOH on April 2, 2025 (see supporting documents). That threatening text later disappeared from multiple personal devices in what appears to be a digital hacking or other compromise of my "secure" and encrypted systems.

Also, please refer to these court cases that I plan to mention during testimony:
    2CCV-25-0003634
    2DSS-25-0000206
    SCEC-26-0000600

Please include these materials in the testimony record. Thank you for considering these concerns, and proposed investments in safer wastewater treatment, expanded water reuse, and reef protection.

Myself along with over 20 different ohana highly oppose this. The lands you have been discussing in this meetings about south/south east Maui have incorrect information, because the supposed "owners" you guys have been talking about are the incorrect and illegal owners. The OWNERS of those lands ARE THE ORIGINAL TITLE HOLDERS from the mahele made by the Hawaiian Kingdom from Kamehameha 3 & By GOD that belongs to the ORIGINAL TITLE HOLDERS & their descendants FOREVER!!
Not only these plans are a state violation from HRS but is a violation on an interernational level being hawaiian kingdom lands!!!! RETURN THE LANDS TO THE ORIGINAL TITLE HOLDER and descendants BY LAW!!!
Allodial Titles are Forever for kanaka maoli/Kanaka Hawaii Maoli, and Fee Simple or Lease (only 30 years) are for Aliens. The Aliens can never own Allodial Titles which is exclusively for kanaka maoli/Kanaka Hawaii Maoli only.
The Usurpers moved to promote Fraud, Deceit, Criminal Malfeasance, piracy, pillaging, racketeering, privateering, Genocide to criminally claim what they could never own. Allodial lands are forever, and forever lands which are the Paramount, Superior Titles deeded to kanaka maoli Kamehameha III & By GOD- Kauikeaouli.
A small list naming a few of original title holders/owners of those lands and if developed( to name only a portion of the families) you will be misplacing the families of-

+More who have never been even compensated, CONTACTED or involved with this!!! No matter if sold which the original title holders would LEASE, THEY OWN THE LANDS NOW AND FOREVER
The original title holder from the mahele and their descendants own them FOREVER thats what ano alodio is ALLODIAL TITLE meaning FOREVER and sense the state of hawaii based 172-11 off of hawaiian kingdom law, the word inure is supposed to be ENURE because Kamehameha 3 DID NOT use the blackstone legal dictionary with the word inure, Kamehameha 3 used the word "ENURE" which Kamehameha 3 used from the french law book!!!!!! TWO COMPLETLEY DIFFERENT MEANINGS!! SO THAT MEANS ALL THE ORIGINAL TITLE HOLDERS ALL THE ROYAL PATTENTED LANDS and sense ALL HAWAII is royal pattented the descendants of the original royal pattent holders IN FACT DO OWN ALL THOSE LANDS NO MATTER IF you assume they SOLD& NO MATTER WHAT!!!! 99% of the illegal owners who developed that area are NOT descendants of the original title holders which makes them being there illegal because the lands were supposed to revert back to then original title holder and their descendant's FOREVER Ano alodio ALLODIAL TITLED BY KAMEHAMEHA 3 & GOD
