    This bill for an ordinance is putting the cart before the horse. There is no reason to be granting conditional permits when the conditions have not been explored, vetted, costed and budgeted by the requestor Carolee. To get a permit for the septic system will require SMA, and also a certified shoreline. A certified shoreline will reveal that the Higashino's are leasing a property that is much smaller than the current footprint as most of the property is now in the public domain within the State's shoreline. The owner of the property will have to buy an easement for the land within the shoreline or remove the wedding lawn back to the shoreline boundary and down to sea level. For reference the line of coconut trees fronting the beach is most likely in the shoreline as is a good portion of one of the dwellings. Removing these encroachments or buying and easement for them is cost prohibitive for this venture and the Higashinos do not own the property. Further the easement is not exclusive and the events cannot operate or spill over into State Land. Granting a leasee a conditional permit without hearing from the landowner is not good practice or diligent on behalf of this commitee. SMA should not allow a septic system to be built for the purpose of a venue. Again the landowner is ultimately responsible for this. Where is proof of their commitment. The council should require the landowner to remove encroachments and comply with the State's shoreline laws before they entertain any permits conditional or otherwise and base all decisions on the actual property boundaries.

    I have known Carolee for the better part of 30 years. She owns and operates her company with professionalism and integrity supporting countless vendors in her efforts including my company and our employees. She will be an excellent steward of that property and a great neighbor to the community. Her 30 + years in business are a testament to that.
