Brian Schatz has secured $36.8 Million dollars for this state for affordable housing, why would you take other people's homes? If you want to curb tourism stop the hotels and time shares from being built. During the pandemic there wasn't even anyone that wanted to rent homes, tourism dried up as well as business, don't create a situation that could put this island back in that situation.
RESOLUTION 22-51, RELATING TO INFRASTRUCTURE IMPROVEMENTS AND RESIDENTIAL WORKFORCE HOUSING FOR THE WAIKAPU COUNTRY TOWN PROJECT (PSLU-48)

I believe that a Council Resolution is an appropriate next step. It should be expanded to make clear the following:
The resolution should emphasize that Waikapu Country Town is a unique situation in which the state, the county, and the private developer and future residents all have much to gain by cooperating and lending their support to a comprehensive solution.
Therefore, the resolution should require that the three parties (State government, Maui County government, and the developer/land owner) all agree to sign a joint binding aggreementt so that each of them will be able to receive the considerable benefits of such a settlement and be able to enforce its provisions..
The settlement agreement would indicate that there are four significant components:
a) The State and County will construct a Waiale Road extension to Honoapilani Highway;
b) Additional lands will be contributed by the developer to construct an elementary school in addition to the middle school at State expense;
c) The developer will convert 213 entitled market-price housing for affordable housing use; and
d) A wastewater treatment plant that will be constructed for the use of Waikapu Country Town and other Central Maui housing projects with the wastewater plant’s effluent reserved for the developer’s agricultural lands and town landscaping.
The Council resolution should appoint an experienced and neutral “Master” who will act as an intermediary to bring the parties together and prepare the settlement agreement.
The settlement would need to be enforceable on all of the parties because all four of these components need to be constructed to make this a viable project. If even one of these elements is not built or is seriously delayed the other three will not work and future residents will be damaged.
The settlement agreement will describe the necessary funding and descriptions of the contributions that each party promises to make. It will include the deadlines by which the various elements need to be completed and the mechanism to force each of the parties to comply with their obligations.
With a signed agreement by all the parties the County Council can then pass any necessary ordinance to modify the conditions for Waikapu Country Town. The State Land Use Commission can modify its approval and conditions for the project.
The key in the Council’s resolution this week will be the need to emphasize how important it will be to have all the parties agree in a comprehensive settlement
